Seguia Terms of Use (pilot)

These Terms are an agreement between you and [NOMBRE DE LA LLC] ("Seguia", "we", "us"). By using Seguia you accept them. If you do not agree, do not use Seguia.

1. The pilot. Seguia is in a free, invitation-only pilot. It is a test version. It is provided "as is" and "as available", without warranties of any kind. It may have errors, stop working, change, or be shut down at any time.

2. What Seguia does. Seguia reads the chats you import, suggests who to follow up with, and drafts messages. Seguia never sends messages on its own. You decide what to send and you send it yourself, from your own phone.

3. The AI can be wrong. Suggestions are generated by artificial intelligence and may be inaccurate or inappropriate. You must review every message before sending it. You are the only person responsible for what you send.

4. Consent and the law. You agree to:

  • Only contact people with whom you already have a relationship.
  • Immediately stop contacting anyone who asks you to stop.
  • Comply with all laws that apply to your messages, including the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act (FTSA), and WhatsApp's own rules.

5. Other people's data. The chats you import contain other people's information (names, phone numbers and messages). You confirm that you have the right to share that information with Seguia and to use it to follow up on your own business relationships.

6. Acceptable use. Do not use Seguia to send spam, harass anyone, break the law, or upload information you have no right to use. Do not share your account, copy Seguia, or try to access other users' data.

7. Your account. Access is by invitation only. Keep your sign-in details secure; you are responsible for activity in your account.

8. Your data belongs to you. You keep all rights to your data. You allow us to store and process it only to provide Seguia to you, as described in the Privacy Policy.

9. Price. The pilot is free. If you later choose a paid plan, we will show you the price before you pay. We will never charge you without your consent. If a price changes, we will tell you at least 30 days in advance.

10. Ending the service. You can stop using Seguia at any time. We can end the pilot or close an account at any time, and we can suspend an account that breaks these Terms. When an account ends, your data is handled as described in the Privacy Policy.

11. Limitation of liability. To the maximum extent permitted by law, Seguia is not liable for indirect, incidental or consequential damages, or for lost profits, clients or data. Our total liability is limited to the amount you paid us in the 12 months before the claim or 100 US dollars, whichever is greater.

12. Your responsibility to us. You agree to cover any claims, damages or costs that result from the messages you send or the data you upload.

13. WhatsApp and Meta. Seguia is not affiliated with, sponsored by, or endorsed by WhatsApp or Meta.

14. Law. These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Florida.

15. Changes. If we change these Terms, we will let you know in Seguia and ask you to accept them again before you continue.

16. Language. If there are differences between the English version and the Spanish version, the English version prevails.

Estos Términos son un acuerdo entre tú y [NOMBRE DE LA LLC] ("Seguia", "nosotros"). Al usar Seguia los aceptas. Si no estás de acuerdo, no uses Seguia.

1. El piloto. Seguia está en un piloto gratuito y solo por invitación. Es una versión de prueba. Se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo. Puede tener errores, dejar de funcionar, cambiar o cerrarse en cualquier momento.

2. Qué hace Seguia. Seguia lee los chats que importas, te sugiere a quién darle seguimiento y redacta mensajes. Seguia nunca envía mensajes por su cuenta. Tú decides qué enviar y lo envías tú mismo, desde tu propio teléfono.

3. La IA puede equivocarse. Las sugerencias las genera inteligencia artificial y pueden ser incorrectas o inapropiadas. Debes revisar cada mensaje antes de enviarlo. Tú eres el único responsable de lo que envías.

4. Consentimiento y la ley. Te comprometes a:

  • Escribir solo a personas con las que ya tienes una relación.
  • Dejar de escribir de inmediato a quien te pida no ser contactado.
  • Cumplir todas las leyes que aplican a tus mensajes, incluidas la Telephone Consumer Protection Act (TCPA), la Florida Telephone Solicitation Act (FTSA) y las reglas de WhatsApp.

5. Datos de otras personas. Los chats que importas contienen información de otras personas (nombres, teléfonos y mensajes). Declaras que tienes derecho a compartir esa información con Seguia y a usarla para dar seguimiento a tus propias relaciones de negocio.

6. Uso aceptable. No uses Seguia para enviar spam, acosar a nadie, violar la ley ni subir información que no tienes derecho a usar. No compartas tu cuenta, no copies Seguia ni intentes entrar a los datos de otros usuarios.

7. Tu cuenta. El acceso es solo por invitación. Protege tus datos de acceso; eres responsable de lo que se haga con tu cuenta.

8. Tus datos son tuyos. Conservas todos los derechos sobre tus datos. Nos permites guardarlos y procesarlos solo para darte el servicio de Seguia, como explica la Política de Privacidad.

9. Precio. El piloto es gratis. Si más adelante eliges un plan pagado, te mostraremos el precio antes de pagar. Nunca te cobraremos sin tu consentimiento. Si un precio cambia, te avisaremos con al menos 30 días de anticipación.

10. Terminar el servicio. Puedes dejar de usar Seguia cuando quieras. Nosotros podemos terminar el piloto o cerrar una cuenta en cualquier momento, y podemos suspender una cuenta que no cumpla estos Términos. Cuando una cuenta termina, tus datos se manejan como dice la Política de Privacidad.

11. Límite de responsabilidad. En la máxima medida que permita la ley, Seguia no responde por daños indirectos, incidentales o consecuentes, ni por pérdida de ganancias, clientes o datos. Nuestra responsabilidad total se limita a lo que nos hayas pagado en los 12 meses anteriores al reclamo o 100 dólares, lo que sea mayor.

12. Tu responsabilidad ante nosotros. Te comprometes a cubrir cualquier reclamo, daño o costo que resulte de los mensajes que envías o de los datos que subes.

13. WhatsApp y Meta. Seguia no está afiliado, patrocinado ni aprobado por WhatsApp ni por Meta.

14. Ley aplicable. Estos Términos se rigen por las leyes del Estado de Florida. Cualquier disputa se resolverá en los tribunales estatales o federales ubicados en Florida.

15. Cambios. Si cambiamos estos Términos, te avisaremos en Seguia y te pediremos aceptarlos de nuevo antes de continuar.

16. Idioma. Si hay diferencias entre la versión en inglés y la versión en español, prevalece la versión en inglés.
